Terms & Conditions
1. Scope
The following General Terms and Conditions apply to all contractual relationships between the German Maritime Museum (DSM) and its contractual partners, insofar as they concern the terms and conditions of business and payment for the purchase of admission tickets, printed materials and store articles, room and guest room bookings, participation in events, participation in public or separately ordered guided tours or the use of other services, including the services provided within the framework of these events (products). They also apply if no separate written contract has been closed.
2. Contract conclusion
The contractual relationship is established between the DSM and the customer by purchase at the museum box office, by online order or after written order confirmation by the DSM following booking or order requests from the customer. Products are only sold to end customers and authorized resellers. In the event of unauthorized resale in its own name, DSM reserves the right to withdraw from the contract for a period of 30 days.
3. Prices and payment
The prices and terms of payment at the time of conclusion of the contract apply. The products offered exclusively by DSM (such as tickets, flyers or extra printed products) are exempt from sales tax pursuant to § 4 No. 20 a. of the German Sales Tax Act (UStG).
We generally offer the following payment options:
- When purchasing at the museum box office, cash payment and payment by Girocard or credit card,
- For online purchases, credit card, SEPA direct debit or PayPal,
- For the shipment of printed products and store items within Germany, a subsequent payment on account; to foreign countries, shipping items are sent only after advance payment,
- For room and guest room bookings a subsequent payment on account,
- For participation in events, advance payment at the museum cash desk (cash or by Girocard or credit card).
Depending on the payment method, the product and the delivery address (e.g. domestic or foreign), fees may vary.
Invoices must be paid within ten days of receipt without deduction. In the event of late payment, DSM is entitled to charge the customer interest on arrears at a rate of 5% above the prime rate. DSM reserves the right to claim higher damages. DSM is entitled to charge a reminder fee of € 5.00 for each reminder after the default has occurred. If an invoice is not paid on time or the agreed advance payment is not made on time, DSM is entitled to withdraw from the contract. If the withdrawal is justified, the customer is not entitled to compensation. Payment by collective invoice is only possible by corresponding agreement. A set-off or reduction against a claim of DSM is only possible with an undisputed or legally binding claim.
4. Delivery
Books and other store products, including confirmation of purchase and invoice, will be sent to the address provided by the customer.
Tickets ordered online, including confirmation of purchase and invoice, will be sent by e-mail to the address provided by the customer.
The customer must print out the ticket and present it at the entrance to the DSM or show it in digital form. Admission will only be granted upon presentation of the ticket with a complete barcode. When purchasing admission tickets or booking event tickets or guided tours with an expiration date, the tickets shall be valid for the day/time of day/timeframe specified on the order.
5. Special provisions for individual products
Guided tours for groups
For all guided tours, the number of participants is limited to 25 persons per booked date and group. For safety reasons, the number of participants may be reduced. The stated registration and tour modalities apply.
Waiting time for booked guided tours: A fee of €25.00 is charged for every half hour or part thereof of waiting time beyond the agreed time. The waiting time begins with the expiry of the agreed time and ends with the start of the service.
Discounted and free products
Without this having to be requested, documentation for discounts must be presented in addition to a personal ID at the entrance to the museum. If corresponding documentation is not presented, the customer must also pay the difference from the normal price in order to be granted admission.
Event rooms (provision, handover, return)
The rooms designated in the contract are available for third-party events at the times stated. Seating and, if necessary, other equipment and services are provided by agreement. The costs incurred will be invoiced according to expenditure.
Defects in the service (product) provided under the contract must be reported immediately, but before the start of the event. Later notifications cannot be accepted. If damage is discovered to the premises, the furnishings, the objects and the technical equipment provided that was not pointed out before the start of the event, it shall be deemed to have been caused by the customer.
6. Cancellation
Paid admission tickets, event tickets or tickets for participation in public guided tours cannot be cancelled, exchanged or redeemed at a later date. A refund may be made as an exception if the ticket was booked in conjunction with a group tour that was cancelled in due time.
The following deadlines apply to booked events - unless separate agreements have been contractually made:
1) Cancellation up to seven working days before the event: no cancellation charge,
2) Cancellation three to seven working days before: a cancellation fee of 50% will be charged,
3) Cancellation within the last two working days before a booked event: a cancellation fee of 100 % will be charged,
4) Cancellation within the last two working days before a booked event when at the same time a catch-up date is arranged: a cancellation fee of 50 % will be charged.
The customer must provide proof that the deadline has been met.
Cancellation of individual services of the offer, such as a reduction in the number of participants, is not possible.
7. Right of cancellation
Cancellation policy
You have the right to cancel a purchase contract concluded with DSM within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must inform us (Deutsches Schifffahrtsmuseum - Leibniz-Institut für Maritime Geschichte; Hans-Scharoun-Platz 1; 27568 Bremerhaven; e-mail: info@dsm.museum) of your decision to withdraw from the contract by means of a clear declaration in writing.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Pursuant to Section 312g (2) Sentence 1 No. 9 of the German Civil Code (BGB), consumers do not have a right of revocation in the case of contracts for the provision of services in the areas of accommodation for purposes other than residential purposes and in connection with leisure activities if the contract provides for a specific date or period for the provision of the services. Therefore, there is no right of cancellation in particular for admission tickets, event tickets and event rooms.
8. Liability
The DSM is liable with the diligence of a prudent businessman/businesswoman for culpable breaches of duty only in cases of gross negligence or intent. Liability is limited to the respective coverage amount of the business liability insurance.
No liability is accepted for the cancellation of an event due to force majeure or other circumstances for which the DSM is not responsible. A postponement of the dates for public events or group tours by up to 30 minutes compared to the offer does not entitle to a reduction of the fee.
10. Final provisions
Subsidiary agreements, amendments and supplements must be made in written form.
The place of performance, place of payment and place of jurisdiction is Bremerhaven.
The law of the Federal Republic of Germany applies.
If any of these terms or conditions should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions of use shall survive and continue to be binding and enforceable., The same applies in the event of any gaps or omissions.
